MCCI Hardware Warranty Terms

This limited warranty applies to products manufactured by MCCI. Products manufactured by other companies and distributed by MCCI have different warranties provided by their vendors.

MCCI Corporation (MCCI) warrants that the for a period of one (1) year following delivery, the MCCI hardware products you have purchased (the "MCCI Products") will (a) perform in accordance with published specifications, and (b) will be free from defects in materials and fabrication quality. In the event an MCCI Product does not meet this warranty, subject to the conditions set forth in these terms and conditions, MCCI's sole obligation will be, at its election, to repair or replace the MCCI Product in question or to refund the purchase price.

This limited warranty only applies to the original purchaser and is not transferable. In the event of a warranty claim under the limited warranty, the purchaser must provide MCCI with verifiable serial number identification of the product. Cables and other accessories are not covered by this warranty.

MCCI MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED. IN NO EVENT WILL MCCI BE LIABLE FOR PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR AN AMOUNT IN EXCESS OF THE PURCHASE PRICE OF THE DEFECTIVE MCCI PRODUCT OR PRODUCTS.

This warranty will not apply to any MCCI Products that have been (a) damaged by lightning, water, or power surges, (b) neglected, altered, abused, or used for a purpose other than the purpose for they were provided, (c) repaired by you or any other party without MCCI's prior written authorization, (d) used in conjunction with a third party product or products not approved in advance by MCCI, become inoperable due to normal wear-and-tear on cables or connectors or (e) otherwise used in a manner inconsistent with any instructions provided by MCCI.
In the event that MCCI repairs or replaces a defective MCCI Product under warranty, the repaired or replaced product will be covered through the end of the original warranty period, but no repair or replacement will extend the warranty term past the Warranty anniversary of the delivery date of the original MCCI Product.

This warranty contains the entire agreement between you and MCCI with respect to any warranty matters, and supersedes any and all other written or oral statements, representations or agreements relating to the subject matter of this warranty. If you purchased the MCCI Products from a party other than MCCI, MCCI reserves the right to require proof of purchase to verify the timeliness of your request.

Any and all disputes arising out of or relating to the purchase or use of MCCI Products, including any warranty claims, will be governed by the laws of the State of New York without regards to conflicts of laws principles. Any action arising out of or relating to the MCCI Products must be brought only the Federal and state courts located in the State of New York, and by accepting the MCCI Products, you hereby consent to the personal jurisdiction of such courts and agree not to raise any argument of lack of personal jurisdiction or inconvenient forum or otherwise attempt to transfer such action from, or dispute the jurisdiction of, such courts. YOU HEREBY WAIVE THE RIGHT TO A JURY TRIAL.
